CampMap.app Terms of Service

• Service - the CampMap.app online platform, available at campmap.app and via mobile applications.
• Operator - Axperts Dariusz Zalewski, ul. Pelikana 1/3, 71-698 Szczecin, Poland, VAT ID: 851 319 2109, REGON: 363785540, e-mail: [email protected], tel. +48 789 072 764, administrator and operator of the Service and the entity settling payments through Stripe.
• Rights Holder - EMS Magdalena Stasiak, ul. Wolności 14, 73-222 Rzecko, Poland, VAT ID: 5941491642, REGON: 365235217, tel. +48 662 087 048 - holder of the economic copyright to the Service and executive manager of the project. Services to Users are provided by the Operator.
• User - any person using the Service, including Guests and Owners.
• Guest - a User searching for or booking accommodation through the Service.
• Owner - a User operating a campsite who has published a listing on the Service.
• Property - a campsite, tent field, bivouac spot, service point or other outdoor accommodation.
• Booking - a Guest's request to reserve a stay at a Property, submitted through the Service.
• Listing - a description of a Property published by an Owner on the Service.

1. CampMap.app is an intermediary platform that enables Guests to search for and book campsites, and Owners to present their properties.
2. The Operator is not a party to the agreement between the Guest and the Owner. The Operator is not liable for the quality of services provided by Owners.
3. Using the Service for browsing and searching is free of charge and does not require registration.
4. The Service is available in Polish, English and German. In the event of discrepancies between language versions, the Polish version prevails.
5. The Service is intended for persons aged 16 and over.

1. Registration on the Service is voluntary and free of charge.
2. An active email address is required for registration. Registration is also possible using a Google or Apple account (OAuth).
3. The User undertakes to provide truthful data and to keep it up to date.
4. The User is responsible for the security of their password and should not share login details with third parties.
5. The Operator reserves the right to suspend or delete the account of a User who violates the Terms, without prior notice in cases of gross violations.
6. The User may delete their account at any time by contacting the Operator at: [email protected].

The Service enables you to:

• Browse campsites on an interactive satellite map
• Search for properties by location, type, price and amenities
• View detailed descriptions, photos and reviews of properties
• Submit booking requests (after logging in)
• Add reviews and ratings of visited properties (after logging in)
• Save favorite locations (after logging in)
• Manage a campsite (for Owners)
• Navigate to a property using Google Maps

1. A booking made through the Service constitutes a booking request, not a guarantee of availability. The Owner has the right to confirm or reject the booking.
2. After submitting a booking, the Guest will receive an email confirmation. The Owner will contact the Guest regarding the details and any payment.
3. Cancellation terms are set by the Owner in the Property description. The Service does not participate in the cancellation or refund process.
4. The Service may charge a service fee based on the booking value. The amount of the fee is clearly communicated before the booking is finalized.
5. The Operator does not guarantee the availability, condition or quality of Properties. Any complaints regarding a stay should be directed to the Owner directly.

1. The Owner undertakes to provide truthful, current and complete information about their Property.
2. Photos added to a Listing must be owned by the Owner or the Owner must hold the rights to publish them.
3. The Owner undertakes to respond to booking requests within a reasonable time (we recommend within 48 hours).
4. The Owner bears full responsibility for the safety of guests on the Property premises.
5. The Operator reserves the right to remove a Listing that contains false information, infringes the rights of third parties or violates the Terms.
6. The first 100 registered Properties benefit from a free listing with no time limit (promotional offer).

1. A User may add a review of a Property after logging into their account.
2. Reviews should be factual, based on personal experience and expressed in a respectful manner.
3. The following is prohibited: publishing offensive, vulgar or discriminatory content, content containing other people's personal data, spam or advertising.
4. The Operator does not moderate reviews before publication but reserves the right to remove reviews that violate the Terms.
5. The Property Owner has the right to respond to any review. The response must be factual and compliant with the Terms.
6. Manipulating ratings (fake reviews, buying reviews) is prohibited and results in account deletion.

1. Browsing the Service, searching and reading reviews is free of charge.
2. Account registration is free of charge for both Guests and Owners.
3. The Service may charge a service fee on bookings made through the platform. The fee is currently 8% of the booking value.
4. Payments for a stay are made directly between the Guest and the Owner, unless the Service offers an integrated payment system.
5. All prices displayed on the Service are shown in the currency selected by the User. Exchange rates are indicative only.

1. The Operator makes every effort to ensure the Service operates continuously and without errors but does not guarantee uninterrupted access.
2. The Operator is not liable for:
   • The quality, safety and conformity with the description of services provided by Owners
   • Losses arising from the use of information contained in the Service
   • Content published by Users (reviews, photos)
   • Interruptions to the Service caused by force majeure or maintenance work
3. The Operator's liability towards a User is limited to the amount of service fees collected from that User over the last 12 months.

1. The CampMap.app Service, including its name, logo, interface, source code and databases, is the property of the Operator and is protected by copyright.
2. Content added by Users (reviews, photos) remains the property of its authors, but the User grants the Operator a non-exclusive, royalty-free license to publish it on the Service.
3. Copying, reproducing or using the content of the Service without the written consent of the Operator is prohibited.

1. Complaints regarding the operation of the Service should be reported by email to: [email protected].
2. A complaint should include: first and last name, email address, a description of the problem and the expected resolution.
3. The Operator processes complaints within 14 business days of receipt.
4. Complaints regarding the quality of Owners' services should be directed to the Owners directly.

1. The User may cease using the Service at any time.
2. The User may request account deletion by sending an email to: [email protected]. The account will be deleted within 14 days.
3. The Operator may terminate the agreement with a User who violates the Terms, subject to a 7-day notice period, except in cases of gross violations (immediate effect).
4. Deleting an account does not affect reviews published by the User - they remain on the Service in anonymized form, unless the User requests their removal.

1. The Terms are governed by Polish law.
2. Disputes arising from the use of the Service will be resolved by the common court with jurisdiction over the Operator's registered office, unless the law provides otherwise (in particular, for consumers - the court with jurisdiction over the consumer's place of residence).
3. A consumer has the right to use out-of-court dispute resolution methods, including the European Commission's ODR platform: ec.europa.eu/consumers/odr.

1. The Operator reserves the right to amend the Terms.
2. Users will be informed of significant changes by email or via a visible notice on the Service, at least 14 days before the changes take effect.
3. Continued use of the Service after the changes take effect constitutes acceptance of them.
4. A User who does not accept the changes may delete their account in accordance with §12.
